Effective: This Terms of Service Policy becomes effective on the date you first subscribe or register the AIME mobile application.

PLEASE READ THIS POLICY CAREFULLY BEFORE SUBSCRIBING OR USE THE MOBILE APPLICATION

AIME designs software and tools to help you achieve your health and wellness goals and empower and inspire you to lead healthier, more active lives. This is a legal agreement between the person or organization (“Customer,” “Subscriber,” or “you”) agreeing to these Terms of Use (“Terms”) and the applicable AIME licensing entities (“CCAM, LLC,” “AIME,” “Seller,” “we,” “us”). You agree to be bound by these Terms any time you use, access, or visit aimescan.com (the “Site”), use our mobile application software (“Software”), and any of our other products or services located on the Site or through the Software (together with the Site and the Software referred to herein as the “Services”). Your use of the Services is subject to your acceptance and compliance with these Terms. “Use” or “using” means to access, install, download, or otherwise benefit from using the functionality of the Services. If you disagree with these Terms, do not use the Services. AIME may revise these Terms at any time without notice. Each time you access or use the Services, the current version of these Terms will apply. These Terms will always be available on the Site.

By using the Services, you also agree to abide by any rules, policies, and procedures we may publish on the Services from time to time. We reserve the right to change these Terms at any time and without notice. If you have questions regarding these Terms, please contact us.

If you do not agree to be bound by these Terms, you must leave this Site and are not authorized to use our Services.

USE OF AIME SERVICES

Persons under 18, or any higher minimum age in the jurisdiction where that person resides, are not permitted to access or use the Services unless their parent has consented under applicable law. Additionally, you cannot access or use the Services if you are barred from receiving services under applicable law or have previously been suspended or removed from any AIME Service.

OWNERSHIP AND INTELLECTUAL PROPERTY

Copyrights, trademarks, patents, trade secrets, and other intellectual property and proprietary laws and rights may protect the Site or mobile application. You may not claim intellectual or exclusive ownership rights to our products or Services. All products and Services are the property of AIME and CCAM, LLC. Any unauthorized use or violation of these Terms may violate applicable law.

PAYMENT

Stripe, our authorized credit card processor, handles payments. In no case shall AIME be liable for taking responsibility or compensating for financial damages. AIME agrees to enforce all applicable laws and cooperate with the appropriate authorities to prevent fraudulent purchases and other unlawful activities.

SUBSCRIPTION AND RECURRING BILLING

By purchasing, renewing, or upgrading an AIME subscription, you authorize us to charge you future renewal fees automatically. Renewal dates and estimated prices will be clearly stated, and we will send email notifications before re-billing. You may cancel your subscription at any time. You will continue to have access to your scanning ability until the listed expiry date. If we cannot charge you the renewal fee, your subscription will be deactivated, and you will lose access to the mobile application.

PRICING

We reserve the right to change the pricing of our products and Services at any time for any reason, including the renewal pricing of subscriptions. In such a case, we will notify affected subscribers in time, providing them with an opportunity to cancel their subscription in advance of the price change. Notifications will be made via email using the email address provided during checkout.

NOTIFICATION

AIME may send you email notifications related to the Services. These notifications may relate to changes to these Terms or any non-promotional matters.

SITE LINKS

Third-party websites may contain links to Services. AIME has not reviewed all such websites and is not responsible for the information and content displayed on them. We have no control over third-party websites, and the inclusion of any link pointing to our Site does not imply endorsement by AIME. Additionally, our Site may contain links to external sources. We have no control over these websites and services, so AIME takes no liability for the content displayed or how these websites operate.

THIRD-PARTY SOFTWARE

AIME Services may use third-party software. The use of third-party materials included in our Site and mobile application may be subject to other Terms and conditions. AIME respects the intellectual property of others and expects its subscribers to do the same. In appropriate circumstances and at our discretion, it is AIME’s policy to disable or terminate the accounts of users who repeatedly infringe the rights of any copyright holders.

FAIR USE AND ACCOUNT SUSPENSION

AIME reserves the right to apply sanctions in cases of breaching these Terms. These might include refusing to supply Software updates and other downloadable assets, refusing to provide customer support, or completely turning off your application token or account. In such cases, we are unable to process refunds.

TERMINATION

These Terms are effective until terminated. Failure to comply with any provisions of these Terms might result in an automatic termination without notice. Upon termination of these Terms, you shall cease all use and destroy or remove all copies, full or partial, of the Software on all devices and media in your possession or control.

REVISIONS AND ERRATA

The materials appearing on the Site could include technical, typographical, or photographic errors. AIME does not warrant that any materials on the Site are accurate, complete, or current. AIME may change the materials on the Site at any time without notice.

JURISDICTION AND VENUE

These Terms shall be governed by the laws of the state of Wyoming or, at AIME’s sole discretion, the laws of any court that may have jurisdiction. You agree that AIME, at its sole discretion, may elect to bring legal action regarding any dispute arising from or in connection with these Terms before the courts of Wyoming, United States, or in any court in any state which may have jurisdiction and you herewith irrevocably and unconditionally submit to the exclusive jurisdiction of the courts chosen by AIME.

WARRANTY DISCLAIMER

The Services are provided “as is”. AIME makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, AIME does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Website or mobile application otherwise relating to such materials or on any sites linked to this site.

LIMITATIONS OF LIABILITY

To the extent not prohibited by applicable law, in no event shall AIME or its suppliers, affiliates, employees, and representatives be liable for any damages (including, without limitation, damages for loss of data or profit or due to business interruption) arising out of the use or inability to use the Services provided by AIME, even if AIME or an authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
